Terms of Service

Effective date: July 31, 2026 · what changed: warranty claim process added, implied-warranty wording fixed, liability floor raised — all in your favor

These terms are an agreement between you and ColdMinder LLC (“ColdMinder”, “we”, “us”), a Virginia limited liability company. They cover the ColdMinder hardware (gateway smart plug and wireless sensors), the ColdMinder apps (iOS, Android, web), and the cloud service behind them — together, the “Service”. By creating an account or using the Service you agree to these terms. Our Privacy Policy explains how we handle data and is part of this agreement.

The short version

1. ColdMinder is not a safety device

Read this section even if you read nothing else.

ColdMinder is a monitoring aid. It watches your appliance and tells you what it sees. It is not a substitute for safe food handling, for medical or regulated cold-chain storage, or for your own judgment.

The Service is built to be honest about its own health — it shows when monitoring is paused, when a sensor is offline, and when data was recovered after the fact rather than seen live. But telling you when we were blind is not the same as always seeing.

2. The Service

ColdMinder shows live and historical readings from your sensors and gateway, sends the alerts you configure, offers diagnoses (for example, “likely a door left open”), lets you manually pull sensor-stored readings with Sync trip after an outage, and — only if you enable it — provides an optional control mode (Section 4). We may add, change, or retire features; if we retire something you rely on, we will give reasonable notice.

3. Beta / TestFlight period

While ColdMinder is distributed through TestFlight or otherwise marked as beta:

This section stops applying to a build once we designate it a general release.

4. Control mode (optional) — you’re taking the wheel

Monitoring is the product. Control mode is off by default and does nothing unless the household owner deliberately enables and configures it. When enabled, the Service can switch your appliance’s power through the smart plug based on the configuration you set.

For a keezer or kegerator, we recommend two temperature sensors, including one low in the cabinet as a floor witness. Control mode does not support fermentation ramps today.

5. Your account

You need an account to use the Service. Keep your credentials to yourself — household sharing exists so you never need to share a password. You are responsible for activity under your account. You must be at least 13 to create an account.

6. Household sharing, roles, and the audit log

You can invite others to your household. Members sign in with their own accounts and see the same appliances, with the role you assign (owner, member, or viewer). You are responsible for who you invite: members see the household’s appliance data, and members with sufficient roles can change settings and — if control mode is on — switch appliance power. The Service keeps an audit log of actions that affect the household, visible to the owner. Owners can remove members at any time; members can leave at any time.

7. Proof links

A proof link is a public page you create voluntarily to show an appliance’s temperature record to someone outside your household. It freezes the selected period when you create it; later readings do not rewrite that snapshot. Anyone with the link can view it until it expires or you revoke it. Do not misrepresent a proof link — for example, by doctoring one or presenting one appliance’s record as another’s. Proof links are an informational summary, not a certified or regulatory compliance record.

8. Acceptable use

Don’t: break the law with the Service; probe, overload, or interfere with it or with other people’s data; access accounts, households, or devices that aren’t yours; or resell the Service. Do not use ColdMinder anywhere its failure could lead to personal injury — it is a consumer appliance monitor.

9. Your hardware

The ColdMinder hardware you bought is yours. Its cloud-connected features require the Service and an account; if your account closes or the Service is discontinued, those features stop working.

One-year limited warranty. ColdMinder hardware carries a one-year limited warranty from delivery against defects in materials and workmanship. If it's defective, we replace it; if we can't replace it, we refund it. To make a claim, email support@coldminder.com with your order number and what's wrong; on a valid US warranty claim, we pay shipping both ways. The warranty doesn't cover damage from drops, liquid beyond the sensors' rating, disassembly, or use outside the documentation. Any implied warranties on the hardware are limited to the same one-year period — see Section 12. This warranty gives you specific legal rights; you may have others that vary by state. Returns: you have 30 days from delivery, and the original packaging is required. For a change-of-mind return, you buy the return label. If the item arrived defective or we shipped the wrong thing, we email you a prepaid label. We issue a full refund to the original payment method within 5–10 business days after the return arrives. Start by replying to your order email or writing support@coldminder.com; the same policy is at coldminder.com/shop/faq. You also keep the consumer protections your local law gives you.

Pre-orders and the ship window. ColdMinder hardware is sold as a pre-order: you are charged at checkout, and first orders are expected to ship in Q4 2026. That date is our honest current estimate, not a guarantee. Because you pay well before we ship:

Once an order has shipped, the 30-day return right above applies instead.

10. Fees and Live Plus

Hardware is sold at the price shown at checkout, with free US shipping; the checkout page's total is the total. What you buy works without a subscription.

Live Plus. Each eligible kit includes Live Plus for the first year. After that included year, Live Plus costs $29/year for every home you own and add to the same billing account; a home is charged only once regardless of how many people belong to it. Live Plus renews automatically each year until canceled. You can cancel in the app before renewal, and a Live Plus charge is fully refundable on request by emailing support@coldminder.com.

Live Plus does not unlock an additional shipped product. Included Core keeps monitoring, alerts, ranges, history, exports, household sharing, manual Sync trip imports, trip monitoring, and recorded-air records working without Live Plus; no feature shipped with your purchase will move behind a paywall retroactively. Purchases made through the App Store or Google Play, if offered there, also follow Apple's or Google's billing and refund rules. Hardware refunds follow Section 9.

11. Termination

You can stop using the Service at any time. You can delete your account from inside the app (Settings → Delete account); this removes your data and frees your hardware to be set up again by someone else, as described in the Privacy Policy, Section 8. We may suspend or terminate accounts that violate these terms or create risk for us or for other users — with notice and a reason except where the violation makes that impractical. Sections 1, 4, 12, 13, and 14 survive termination.

12. Disclaimers

The Service — the apps and the cloud service, including beta builds — is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and uninterrupted or error-free operation. Section 1 is part of this disclaimer.

The hardware is different, because Section 9 gives you a written warranty. We do not disclaim implied warranties on the hardware. Instead, to the extent the law permits, any implied warranties on the hardware (including merchantability and fitness for a particular purpose) are limited in duration to the one-year term of that written warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Some jurisdictions limit disclaimers of implied warranties, so parts of this section may not apply to you.

13. Limitation of liability

To the maximum extent the law allows:

Nothing in these terms limits or excludes liability for gross negligence, willful misconduct, fraud, personal injury caused by our negligence, or anything else that applicable law does not allow us to limit — including any rights under the Virginia Consumer Protection Act that cannot be waived.

Some jurisdictions do not allow some of these limitations, so parts of this section may not apply to you.

14. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Virginia, and you and we each consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court where you live.

Before filing anything, email support@coldminder.com and give us 30 days to make it right.

15. Changes to these terms

We may update these terms. For material changes we will notify you in the app or by email before they take effect; continuing to use the Service after that is acceptance. If you don’t agree, stop using the Service and close your account.

16. General

These terms plus the Privacy Policy are the entire agreement. If a provision is unenforceable, the rest stands. You may not assign this agreement; we may assign it in connection with a sale or reorganization of the business. Our not enforcing a provision is not a waiver of it.
